Mortgage Lenders' Solicitors Letter

If you are in arrears with your mortgage lender and owe more than 2 months payments, you will probably receive a letter from your lender's solicitors informing you that they have been instructed to start possession (repossession) proceedings against you for the possession of your home.

Do not ignore this letter. You may still be able to speak directly to your lender, but some lenders will insist you now speak only to their solicitors. Try not to be intimidated by them and make sure that any agreements are in writing.

How To Deal With Lender's Solicitors Letters

  • Open all letters as soon you receive them
  • Respond in writing wherever possible and keep copies
  • Keep a record all phone conversations and make notes of what was discussed
  • These copies may be needed if you lender takes you to court for repossession
  • Try not to be intimidated by your lender's solicitors. Ultimately it is a County Court Judge that makes all decisions about repossession
